These Terms of Service (“Terms”) govern your access to and use of the Strictly Motors online marketplace, including any website, mobile application, or related services (collectively, the “Platform”) operated by StrictlyMotors LLC, doing business as Strictly Motors (“Strictly Motors”, “we”, “us”, or “our”).

By accessing or using the Platform, you (“user”, “you”, or “your”) agree to be bound by these Terms. If you do not agree, do not use the Platform.

  1. Platform Overview & Role

Strictly Motors is a peer-to-peer and dealer listing platform that allows users to post, browse, and inquire about vehicles and motor-powered items. Strictly Motors is not a party to any transaction between users. We do not own, inspect, verify, endorse, or guarantee any listings, items, payments, or users.

All sales, negotiations, payments, and disputes are strictly between buyers and sellers. You acknowledge that Strictly Motors has zero liability arising from any interactions, communications, or transactions between users.

  1. Eligibility     •    You must be at least 18 years old to use the Platform.     •    By using the Platform, you affirm that you are legally able to enter into binding agreements.

  1. User Accounts

You are responsible for maintaining the confidentiality of your account information. You agree not to impersonate others or create multiple fraudulent accounts. We may suspend or terminate any account at our sole discretion.

  1. Listings & Acceptable Use

Users may list vehicles or motor-powered items such as cars, motorcycles, ATVs, boats, jet skis, lawn equipment, machinery, etc.

You agree NOT to list, sell, or promote:     •    Stolen, illegal, unsafe, or fraudulent items     •    Items without proper ownership or transfer rights     •    Misrepresented or inaccurately described items     •    Any content that is defamatory, abusive, discriminatory, obscene, or unlawful

Strictly Motors may remove or modify any listing at any time for any reason.

  1. Payment & Fees     •    Strictly Motors does not facilitate or process transactions between buyers and sellers for listed items. Buyers and sellers are solely responsible for arranging payments (e.g., cash, bank transfer, third-party services).     •    In the future, Strictly Motors may offer paid features such as premium listings, advertising, or dealer plans. By continuing to use the Platform, you agree that such fees may be introduced and modified at our discretion.

  1. No Guarantee of Accuracy

Strictly Motors does not verify user-provided information. Listings may contain errors, omissions, or false claims. You are solely responsible for verifying all details, inspecting items, and conducting due diligence before any transaction.

  1. User Content & License

By posting listings, photos, descriptions, or messages (“User Content”), you grant Strictly Motors a non-exclusive, worldwide, royalty-free license to use, display, promote, or distribute such content for the purpose of operating and marketing the Platform.

You represent that you own or have the right to use and share all content you post.

  1. Disputes Between Users

Strictly Motors is not responsible for mediating disputes between users. All claims, chargebacks, fraud reports, or disagreements must be resolved directly between buyer and seller.

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND. STRICTLY MOTORS DISCLAIMS ALL LIABILITY FOR:     •    Item quality, legality, ownership, safety, or availability     •    Loss, theft, fraud, or financial damages     •    Communications or conduct of users, buyers, or sellers     •    Any reliance on listings or information provided on the Platform

  1. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STRICTLY MOTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, REPUTATIONAL HARM, OR PERSONAL INJURY ARISING FROM USE OF THE PLATFORM OR ANY TRANSACTION BETWEEN USERS.

  1. Termination

Strictly Motors may suspend or terminate access to any user at any time, with or without notice, for any reason. Users may delete their accounts at any time.

  1. Governing Law & Dispute Resolution

These Terms shall be governed by the laws of the Unites States of America, without regard to conflict of law principles.

Any dispute arising from or relating to these Terms or your use of the Platform shall be resolved exclusively through binding arbitration, conducted in the United States of America, in accordance with the rules of the American Arbitration Association (AAA). You waive your right to bring claims in court or participate in class actions.

Strictly Motors may update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the revised Terms.
